박 전 대통령 재판에서의 인권유린 지적
‘박근혜 대통령 공정재판을 위한 법률지원단(이하 ’법률지원단‘)’은 지난 11일 성명을 내고, “부상으로 인한 박근혜 전 대통령의 재판 불출석을 재판지연 술수로 매도하는 언론보도 태도를 규탄한다”고 지적했다.
‘법률지원단’은 “박 전 대통령의 재판이 주 4회 증인신문기일을 이어가고 있어 피고인이 불출석한 상태에서도 ‘기일외 증거조사’라는 형태로 재판 진행이 가능하다”면서, “구속사유가 인정되지 않음에도 억지 구속을 강행하고, 무지막지한 조롱과 인신공격으로 대응한다면, 그 사회의 법치적 건강성은 심각하게 위협을 받고 있다고 보아야 한다”고 강조했다.
이어 ‘법률지원단’은 “우리 사회의 언론이 이러한 중차대한 기로의 사명을 깨닫고, 그 보도 태도에서 법치를 존중하며 근시안적인 비방중상을 멀리해 줄 것을 촉구한다”고 밝혔다.
다음은 ‘박근혜 대통령 공정재판을 위한 법률지원단’이 발표한 성명서 전문이다.
“박대통령의 불출석을 재판지연 술수로 매도하는 언론보도 태도를 규탄한다”
“박근혜 대통령이 왼발에 부상을 입고 치료가 제대로 되지 않아 일상적인 거동이 불편할 정도가 되어 이틀째 재판에 출석치 못하고 있다. 그러나 현재 재판은 주 4회 증인신문기일을 이어가고 있어 피고인이 불출석한 상태에서도 <기일외 증거조사>라는 형태로 재판 진행이 가능하다.
재판부는 변호인에게 증인으로 출석한 이들의 신문조서가 재판부에 제출될 수 있도록 협조를 구하고, 변호인측은 이에 따르고 있다. 별도의 기일을 잡아 서증조사를 할 것이라는 예상은 기우에 가깝다. 증언녹취록이 증거로 제출되고, 증인에 대한 변호인측의 반대신문 기회도 주어졌기에 별도의 서증조사가 진행될 근거가 없기 때문이다.
이 문제는 단순히 주4회 재판 속행이라는 비문명적이고 국제적 상례를 벗어난 재판 진행으로 인해 평소 여러 가지 건강상의 애로를 갖고 있던 피고인의 신체에 이상 징후가 오고, 출정 강행시 더욱 상태가 악화되어 장기적인 문제를 야기할 수 있기에 임시적인 조치가 취해진 데 불과하다.
구속사유가 인정되지 않음에도 억지 구속을 강행하고, 구속적부심과 보석신청은 아예 말을 꺼낼 엄두조차 못하게 하며, 건강 이상으로 치료를 위한 불출석을 호소하면서도 재판 진행에 차질이 없게 하는데, 이를 무지막지한 조롱과 인신공격으로 대응한다면, 그 사회의 법치적 건강성은 심각하게 위협을 받고 있다고 보아야 한다.
법치는 특정인을 위해 존재하지 않는다. 법치의 혜택은 법공동체 전원에게 잠재적인 안전망으로 돌아가게 된다. 이를 무시하고 정쟁적 공격으로 치달아 갈 경우, 역사는 그 진행의 끝이 어디인지 20세기 전체를 통해 보여주었다. 법을 무시한 합리성과 정략 추구는 결국 그 사회 구성원이 기댈 안전장치를 모두 파괴하고, 그 이후는 무자비하고 원시적인 힘의 횡행이 필연적으로 등장했다.
박근혜 전 대통령의 공정재판을 위한 법률지원단은 우리 사회 언론이 이러한 중차대한 기로의 사명을 깨닫고, 그 보도 태도에서 법치를 존중하며 근시안적인 비방중상을 멀리해 줄 것을 간곡히 촉구하는 바이다.“

STATEMENT
We condemn the Korean press for denouncing President Park for absence from her trials as tactical delay of the trials.
President Park has an injury on her left foot which is not known or reported to have been cared of and she has difficulties with moving or walking and she is not able to appear at her trials. She has continuousely been taken to the court and questioned for four full days a week in spite of her difficulties.
The laws permit proceedings of trials without presence of the accused. Also the judges may seek for lawyers cooperation for submission of interrogatory of testifiers without questioning the testifiers directly and the defendant lawyers accept the procedures as opprtunities are allowed to the lawyers for cross examinations. The problem is that four full days a week trial is an abnormal proceedings and it should be criticized as uncivilization and unusual practice in any nation of the world. These proceedings could clearly bring about additional health problem to her and it is necessary that any extraordinary arrangements for protection to be taken immediately for the President.
Any legal reasons of detention of the President have not been revealed or established yet and the court continuesly keep her in jail.Reviews of of the legal reasons for the detention and applications of bail have been refused by the court. The defendant has respected the proceedings at the court and has appealed for her absence on the reasons of her injury and other additional bad health conditions. On the contrary, the press has attacked and even ridiculed her appeals. This situation reveals that sound functions of our laws are seriously thretened.
The laws do not exist for protection of any special persons. The benefits of laws are presumed to be shared by all the legal persons in a society. To ignore this presumption, attacking the defendants politically, has been revealed to be a serious problem through the history. Any special part or group of the society's wrong rationalization and political pursuing against laws can destruct the safety of the society, which have naturally brought about cruel execution of the force.
We the Lawyers Team for Legal Support to the President for Fair Trials demand the press to realize the serious situation which we and the President meet at the moment and to respect the laws concerened when report and not to slander any persons without reveals or proofs of reasons and truth.
